Important: By booking, paying for, or attending an appointment, the client confirms that they have read and accepted these Terms and Conditions. These terms do not affect the client's statutory consumer rights.
1. Scope of these Terms
These Terms and Conditions apply to all appointments, treatments, sessions, classes, workshops and related wellbeing services provided by Mindful Meditation (collectively, the “Services”). In these terms, “client” means the person receiving or booking a Service, and “we”, “us” or “our” means Mindful Meditation.
Any treatment-specific information, consultation form, consent form, booking confirmation or privacy notice provided to the client forms part of the agreement. If there is an inconsistency, any mandatory legal right will take priority, followed by any specific written term agreed for the particular Service.
2. Nature of the Services
Our Services are intended to support relaxation, general wellbeing and personal development. They are complementary services and are not a substitute for medical diagnosis, treatment, psychotherapy, physiotherapy, psychiatric care or advice from a doctor or other appropriately qualified healthcare professional.
We do not diagnose medical conditions, prescribe medication, advise a client to stop or alter prescribed treatment, or guarantee that any Service will prevent, treat or cure a medical or psychological condition.
3. Health, Suitability and Client Disclosure
Before a Service begins, the client must provide complete and accurate information about any matter that could affect whether the Service is suitable or how it should be adapted. This includes, where relevant, illness, injury, pain, allergies, pregnancy, recent surgery, medication, skin conditions, mental health concerns and any medical advice already received.
By attending, the client confirms, to the best of their knowledge, that they are healthy and fit enough to receive the booked Service, or that they have obtained appropriate medical advice where there is any doubt. The client must tell us promptly about any change in their health or circumstances before or during a Service.
The practitioner is entitled to ask further questions, request medical clearance, adapt a Service, postpone it, or decline to proceed where this is reasonably considered necessary for the client's safety or the practitioner's professional boundaries.
Seek medical advice: If a client has a diagnosed condition, unexplained symptoms, a recent injury or procedure, is pregnant, or is unsure whether a Service is appropriate, they should consult their GP or another suitably qualified healthcare professional before attending.
4. Consent and Communication During a Service
Consent is ongoing. The practitioner will explain the general nature of the Service and any relevant precautions. The client may ask questions, request an adjustment, decline any part of a Service, or withdraw consent and stop the Service at any time.
The client must immediately tell the practitioner about pain, dizziness, numbness, breathing difficulty, emotional distress, discomfort or any unexpected reaction. Where physical touch forms part of a Service, only the agreed areas will be treated and appropriate professional boundaries will be maintained.
5. Appointments, Arrival and Late Attendance
Clients should arrive at the time stated in the booking confirmation, allowing enough time for any required consultation. A late arrival may result in a shorter Service so that the next client's appointment is not delayed. The full booked fee remains payable where the Service is shortened because the client arrived late.
A client who is unwell, has symptoms of a contagious illness, or has been advised not to attend should contact us as soon as possible. We may reschedule or decline an appointment where proceeding could create a health, safety or hygiene risk.
6. Cancellation, Rescheduling and Non-Attendance
48-hour cancellation policy: At least 48 hours' notice is required to cancel or reschedule an appointment without charge.
If less than 48 hours' notice is given, or the client does not attend, up to 100% of the booked fee may be charged. This reflects the appointment time reserved exclusively for the client and the likelihood that the slot cannot be offered to another client at short notice. Any outstanding cancellation charge may be required before another booking is accepted.
We may waive or reduce a charge in exceptional circumstances at our discretion. Any waiver on one occasion does not create a right to a waiver on another occasion. If we cancel an appointment, the client may choose a replacement appointment or a refund of any amount already paid for the cancelled Service.
Nothing in this cancellation policy limits any statutory cancellation or refund right that applies to a booking made online, by telephone, or away from our premises. Where such a right applies, the statutory rules take priority.
7. Fees and Payment
The applicable fee will be stated at or before booking. Payment is due at the time specified in the booking process or, if no time is specified, no later than the appointment. We may require advance payment or a deposit to secure a booking.
Unless otherwise stated, prices are in euro. A refund is not due merely because the client changes their mind after a Service has been fully provided, but this does not affect any remedy available where a Service was not provided with the care, skill or standard required by law.
8. Expected Responses and No Guarantee of Results
Responses to holistic and complementary Services vary from person to person. Temporary effects such as tiredness, emotional sensitivity, tenderness or light-headedness may occur depending on the nature of the Service. The client should follow any reasonable aftercare guidance and seek medical advice if symptoms are severe, unusual or persistent.
No particular outcome or result is promised or guaranteed. Testimonials, descriptions and examples are illustrative and do not guarantee that another client will have the same experience.
9. Conduct, Safety and the Right to Stop a Service
Clients must behave respectfully and must not attend while under the influence of alcohol or non-prescribed drugs. Harassment, threatening behaviour, sexualised conduct, deliberate misuse of the Service or conduct that creates a safety risk will not be tolerated.
We may refuse, pause or end a Service where reasonably necessary for health, safety, hygiene, professional-boundary or misconduct reasons. Where a Service is ended because of the client's serious misconduct, the fee may remain payable to the extent permitted by law.
10. Responsibility and Liability
We will provide the Services with reasonable care and skill. The client remains responsible for giving accurate information, disclosing relevant conditions and following reasonable safety and aftercare instructions.
To the fullest extent permitted by law, Mindful Meditation will not be responsible for an injury, adverse reaction, worsening of a condition, loss or damage to the extent that it results from:
the client's failure to disclose relevant health information or a change in their condition;
information supplied by the client that is inaccurate, incomplete or misleading;
the client's failure to follow reasonable instructions, precautions or aftercare guidance; or
a risk or temporary effect that was reasonably explained before the Service and that did not arise from our failure to exercise reasonable care and skill.
Nothing in these terms excludes or limits liability for death or personal injury arising from our act or omission where such liability cannot lawfully be excluded, for fraud or fraudulent misrepresentation, or for any other liability or statutory consumer right that cannot lawfully be excluded or restricted.
Clients are responsible for their own personal belongings. We are not responsible for loss of or damage to personal property unless it was caused by our failure to take reasonable care or another basis of liability that cannot lawfully be excluded.
11. Children and Clients Requiring Support
A client under 18 may only receive a Service with the prior consent of a parent or legal guardian. Depending on the client's age, needs and the nature of the Service, the parent or guardian may be required to remain present. We may decline a booking if appropriate consent, supervision or safeguarding arrangements are not in place.
A client who needs communication, mobility or other support should tell us when booking so that reasonable arrangements can be discussed. A support person may attend where agreed in advance and where this does not interfere with safety, privacy or delivery of the Service.
12. Privacy and Confidentiality
We may collect contact, booking and health-related information that is reasonably necessary to assess suitability, provide the Service, maintain appropriate records, process payment and meet legal or insurance obligations. Personal information will be handled in accordance with applicable data protection law and our Privacy Notice.
Information shared during an individual Service will be treated respectfully and confidentially, subject to legal obligations and limited exceptions, including where disclosure is required by law or is reasonably necessary to respond to a serious and immediate safety concern. Privacy cannot be guaranteed for information a client chooses to share in a group setting.
13. Complaints
If a client has a concern, they should contact Mindful Meditation using the contact details provided on the website or booking confirmation. We will aim to acknowledge the concern promptly, consider it fairly and, where appropriate, propose a reasonable resolution. This clause does not restrict the client's right to seek independent advice or use any legal or statutory remedy.
14. Changes, Severability and Governing Law
We may update these Terms and Conditions from time to time. The version supplied or made available at the time of booking will normally apply to that booking, unless a change is required by law or is expressly agreed with the client.
If any provision is found to be invalid or unenforceable, it will be treated as removed or limited only to the minimum extent necessary, and the remaining provisions will continue to apply where legally possible.
These Terms and Conditions are governed by the laws of Ireland. The Irish courts will have jurisdiction, subject to any mandatory consumer right to bring proceedings in another court or jurisdiction.
15. Client Confirmation
By booking, paying for, or attending a Service, the client confirms that:
they have read, understood and accepted these Terms and Conditions;
the information they provide is, to the best of their knowledge, complete and accurate;
they will disclose relevant health conditions and changes before and during the Service;
they believe they are healthy and fit enough for the booked Service, or have sought appropriate medical advice where there is any doubt;
they understand that the Services are complementary and are not a replacement for medical advice, diagnosis or treatment; and
they understand that consent is ongoing and that they may ask questions, request an adjustment or stop the Service at any time.
